Overseas Citizenship of India: The Government of India has tightened the rules for Overseas Citizen of India (OCI) card holders. Now if any foreign citizen of Indian origin is convicted of a serious crime or a serious chargesheet is filed against him, then his OCI registration can be canceled.
The gazette notification issued by the Home Ministry clearly states that if an OCI holder is sentenced to two years or more, or a chargesheet is filed against him in a crime whose punishment can be seven years or more, then his card will be canceled.

Overseas Citizenship of India
भारत सरकार ने Overseas Citizen of India (OCI) कार्ड धारकों के लिए नियम सख्त कर दिए हैं। अब अगर कोई भारतीय मूल का विदेशी नागरिक गंभीर अपराध में दोषी ठहराया जाता है या उसके खिलाफ गंभीर आरोपपत्र (चार्जशीट) दाखिल होता है, तो उसका OCI पंजीकरण रद्द किया जा सकता है।
गृह मंत्रालय द्वारा जारी गजट नोटिफिकेशन में साफ कहा गया है कि अगर किसी OCI धारक को दो साल या उससे अधिक की सजा हो जाती है, या उसके खिलाफ ऐसे अपराध में चार्जशीट दाखिल होती है, जिसकी सजा सात साल या उससे अधिक हो सकती है, तो उसका कार्ड रद्द कर दिया जाएगा।
नया नियम क्या कहता है? (New Rules 2025)
गृह मंत्रालय के मुताबिक:
- If an OCI cardholder is sentenced to a minimum of 2 years in prison.
- If a chargesheet is filed against an OCI cardholder for a crime punishable with 7 years or more.
क्यों उठाया गया यह कदम? (Aim Of New Rules)
Government officials say that this step has been taken to strengthen the legal framework related to OCI registration. This will ensure that the benefit of OCI card is given only to those who follow high standards of law and ethics.
However, legal experts believe that the provision of cancelling the card on the basis of charge sheet can raise questions about the judicial process and possible misuse.

- Financial fraud
- Organised crime
- Other serious crimes under the Indian Penal Code (IPC)
Other reasons for OCI card cancellation
विदेश मंत्रालय के मुताबिक, OCI पंजीकरण इन परिस्थितियों में भी रद्द किया जा सकता है:
- Registration has been obtained by fraud, false information or concealment of facts.
- Showing dissatisfaction or opposition to the Indian Constitution.
- Illegal contact or trade with an enemy country during war against India.
- Punishment for 2 years or more within 5 years of registration.
- Deemed necessary for the sovereignty, integrity, security, foreign relations or public interest of India.
OCI योजना क्या है? (About Overseas Citizenship of India)
The OCI scheme was launched in August 2005. Under this, foreign nationals of Indian origin do not need a visa to travel to India. They get the facility of long-term residency and multiple entry.
This facility is available to those who were citizens of India on or after 26 January 1950, or were eligible to become citizens on that date.
But, citizens of Pakistan, Bangladesh or other countries notified by the government (or their children, grandchildren, great-grandchildren) are not eligible for this scheme.
